Terms of reference :

Subject : Technical assistance to support development of updated food legislation promoting healthy diets for children.

Duration : 23 Days over 5 months

Supervisor : Nutrition Manager

Purpose of the assignment :

The purpose of the proposed assignment is to draft Acts and regulations pertaining to transformed food products, food and food standards and their marketing. This assignment will be informed by a comprehensive review of the key legislations include the Constitution of Zimbabwe (2013), the Public Health Act[Chapter 15:09], the Food and Food Standards Act [Chapter 15:04] and  subsidiary legislation, regulations and statutory instruments (partiularly SI48 of 1998, SI5 of 2015) relating to this subject.

Assignments :

The consultant will be responsible for the following :

• Identify and conduct a review of the current legislation regulating food and food standards including marketing of foods in Zimbabwe, in consultation with stakeholders, identify gaps and recommend way forward targeting restricting marketing of unhealthy foods and beverages to infants and children ;
• Review food marketing regulations and recommend how nutrient thresholds set by WHO can be incorporated in acts regulating marketing of foods ;
• Identify opportunities to include global and regional standards on trans-fat, salt/sodium and sugar and restrict marketing of unhealthy foods and drinks and consumer friendly labelling ;
• Develop and propose recommendation into acts and regulations and present to stakeholders ;
• Draft validated recommendations into the acts and regulations and submit to Ministry of Health and Child Care ;
• Develop recommendation guidance for government to adopt

The consultant fee scheduled will be based on deliverables as outlined below :

Conduct consultations with relevant ministries and monitoring authorities to come up with guidance on how government can review relevant acts to restrict marketing of inappropriate foods to infants and children.	A draft recommendation guideline presented to the stakeholders on how to improve legislature to restrict marketing of BMS and other inappropriate food to infants and children	5 days
Propose revisions and recommendations into identified Acts and regulations.	Revisions and recommendations for incorporation into the Acts presented to stakeholders for validation	5 days (40% payment)
Draft validated recommendations into the Acts	Submit proposed draft Acts to the MOHCC	5 days
Write final consultancy report including recommendations, for medium to long term actions	Final Report Presented and all above deliverables handed over in an electronic folder	1 day (50% payment)

 

Consultancy requirements :

• Masters Degree in a relevant field such as Public Health, Law, Statistics, Evaluation, Social Science ;
• Expertise in public health, legislative drafting and extensive knowledge on food standards legislation  a requirement ;
• At least five years of proven experience in conducting qualitative and/or quantitative research in public health specifically food standards legislation  a requirement ;
• Able to work within various teams and be able to contribute to the overall success of that team ;
• Able to demonstrate a flexible and adaptable approach to work ;
• Ability to communicate fluently in English required.

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws.
