Job Description

Ensure that the Company’s business is compliant with all applicable rules and guidance including Anti-Bribery & Corruption (ABC) rules and regulations and policies of external authorities and Total Group standards.
Manage and assist a team of 3 compliance personnel ensuring the business has adequate coverage and advice on its activities.
Sit on the Steering Committees (Europe, US & Asia), as well as Credit and Compliance committees of G&P Trading. He/She Keep up with business activity and advise senior management on compliance aspects of transactions or business developments.
Oversee the development and implementation of procedures including appropriate systems and controls in order to ensure and facilitate compliance with all applicable Exchange Rules and Regulations along with ABC & Total Group Compliance Programme.
Ensure that there are adequate and up to date IT systems in place to assist customer due diligence etc. (in particular Cubelogic C/p database, intranet etc) . Oversee the updating and development of any such systems (in conjunction with the IT and the Credit Dept.)
Manage the company’s relationship with regulators.
Maintain awareness of regulatory developments and their impact on current and future business practices and keep TGP Directors and Senior Management informed of relevant changes to rules and procedures.  Identify any future new regulations and their potential impact on the business.  Lead and co-ordinate projects to implement new rules and procedures.
Ensure that appropriate compliance training and updates are given to Directors, Senior Management, Relevant Persons and all employees and new employees.
Prepare Annual compliance and Audit reports (regulatory risk analysis).  Oversee and ensure the Compliance Monitoring Programme is followed and completed.
Oversee implementation of Anti-Bribery & Corruption training and monitoring as per Total Group Policies and liaison with the Group Compliance Officers.
Co-ordinate, liaise with local Trading offices around the world as well as coordinate compliance initiatives decided by management across the jurisdictions in which Trading operates.
Identify any potential breaches or weakness in systems and controls and implement practices to correct them.

The role holder is the primary contact for day to day issues relating to applicable regulation and compliance, as well as anti-money laundering matters.
He/She is Responsible for the implementation and maintenance of control procedures in relation to Compliance and Bribery & Corruption.
He/She Ensures regulatory and compliance risks are identified, mitigated and robust systems and controls are in place surrounding these risk areas.
Oversees and coordinate financial regulatory licence applications for the TGPA Singapore office (including Australia) and implement a read across regime for AML standards in respect of these non-UK jurisdictions.
He/She Must ensure day to day management of TGP responsibilities as defined by the regulators, exchanges and other relevant authorities and internal procedures and training of employees to prevent potentially unlimited fines and disciplinary action.

Context and environment

Reporting to the Finance Director of Total Gas & Power Ltd (TGP), who in turn reports to the President, Gas & Power, the Head of Compliance directly manages the Compliance function of TGPL Trading & Corporate (3 staff based at the Branch office of Geneva, Switzerland) and coordinates Trading and Corporate compliance matters across G&P Trading (Houston, Singapore, Australia). He/She acts as Money-Laundering Reporting Officer (MLRO) of TGP in application of UK, Swiss & EU regulations.
The position involves extensive interaction with Trading personnel, Gas & Power Business and Corporate managers, Group compliance teams at Total S.A., as well as regulators, auditors, and trading counterparties.

Due to the size and complexity of Trading activities, the Head of compliance needs to build strong and transparent relationships at various levels of the Total organisation and with third parties (auditors, counterparts, regulators and advisors).
He/She must communicate effectively on results, plans, issues and achievements across a wide range of stakeholders in several countries.
The complex and fast-changing regulatory environment of commodities trading implies that functions such as Compliance develop and maintain a strong expertise of applicable and developing rules, coupled with an excellent understanding of the Trading business, in order to properly exercise their control functions.
Finally, a key element of the role is the operational and functional management of a growing, transverse and challenging function with leadership skills to be applied across the board.

Candidate profile

Degree Educated with relevant legal/compliance professional qualification.
A minimum of 15 years experience of working in a compliance function with commodities experience. Proven expertise of UK compliance issues and relevant financial services laws and regulations and the practical implications of such rules and the ensuring the firm meets these standards.
Solid understanding of EU and US rules that may impact the business, working knowledge of EMIR, MAD, REMIT & MiFID essential.  US Dodd-Frank, Australian and Singapore local rules an advantage.
This position requires autonomy, discipline, to be resourceful and well organised. Self-confidence, tempered with self-evaluation and the ability to identify when to seek assistance. Be proactive, and have good ability to convince and influence. Good communication skills and service-oriented and to manage and motivate a team of compliance professionals.
